Olena Drozdova specifies weaknesses and controversies of Transplantation Act

The transplantation of human organs and anatomical materials is an extremely complex issue that requires not only significant attention of health professionals, but also proper legal regulation, given that the question is about human life and dignity and not merely about biological materials.

Dyvys.info News Agency asked Drozdova & Partners Law Firm Director Olena Drozdova to tell about strengths and weaknesses of the recently passed Act amending certain Ukrainian legislative instruments on health care and transplantation of human organs and anatomical material.

‘On the plus side, the Act is certainly of great importance for the regulation of transplantation and state control procedures. But, on the minus side, it has certain controversies and weaknesses that may cause harm to physical and moral health of individuals and give rise to numerous local and international suits,’ the expert has pointed out by giving some examples.

The expert has expressed her hopes that those legislation gaps will be addressed in part by resolutions of the Cabinet who will regulate the relations in question.
