Taras Hereliuk tells about four issues raised in case over advocate congress’s election of new member of High Qualification Commission of Judges

Oleksandr Drozdov has been elected to a vacant seat of the High Qualification Commission of Judges, which seat was announced as vacant by the Commission itself. This resolution, voted for by 172 of 177 attendees of the congress, is not anyhow related to the dismissal of Pavlo Lutsiuk.

This is what advocate Taras Hereliuk, who represents the interests of Oleksandr Drozdov, a member of the High Qualification Commission of Judges, in proceedings involving the suspension of two resolutions of the Ukrainian advocate congress of 15 February 2019, said.

It is our reminder that the congress resolved that 1) Pavlo Lutsiuk should be dismissed as a member of the High Qualification Commission of Judges, and that 2) Oleksandr Drozdov should be appointed to that vacant seat. The Rivne District Administrative Court put on hold the turnover of the Commission’s members based on a claim and an application filed by the former Chair of the Rivne Region Bar Council until the dispute is resolved on the merits.

This case raises a number of issues Mr Hereliuk has commented on for Law & Business newspaper, including the ruling imposing the injunctive relief.
