‘Drozdova & Partners’ conviction appeal succeeded

The Kharkiv Region Court of Appeal has allowed an appeal against a conviction sentence rendered by Frunzenskyi District Court, Kharkiv and remanded the case for a new trial.

Legal advice on the appeal against the sentence has been provided by advocates of Drozdova & Partners Law Firm. The mother of the person convicted who was found guilty of a robbery and sentenced to imprisonment has contacted the law form for legal advice.

An analysis of the criminal case file has identified a number of violations of procedural law, such as the violation of the right to defence, which further served as a basis for the preparation and submission of the appeal against the sentence.

The Kharkiv Region Court of Appeal has accepted the defendant’s arguments and ruled that the illegal sentence be dismissed and that the case be retried.

‘The accused was actually denied the right to defence given that his advocate suspended his practice. That information was available in the Uniform Ukrainian Bar Register at the time of the trial,’ commented Drozdova & Partners Law Firm senior partner Mr Mykhailo Honcharov. ‘The court failed to check the status of the advocate, which failure, together with other procedural violations, provided a basis for setting aside the verdict.’
