Drozdova & Partners Law Firm has assisted a convicted person in his plea for lenient administrative supervision
The Zhovtnevyi District Court, Kharkiv has supported the motion filed by a representative of Drozdova & Partners Law Firm seeking reduction of the duration and frequency of restrictive measures of administrative supervision over its client.
The mother of a convict found guilty of the distribution of narcotic drugs requested assistance of Drozdova & Partners Law Firm. After the man received and served an imprisonment sentence, the time came to determine the restrictions to be imposed on him in the context of subsequent administrative supervision.
After analysis of available materials and collection of additional characteristics, the lawyer provided the court with substantiation of the possibility to exercise leniency towards the convicted offender in this case.
The court admitted the defence lawyer’s arguments as well-substantiated and ruled to impose the minimal period of administrative supervision over the man after his release from prison and a sparing schedule of visits to probation authorities.
It should be recalled here that Article 158 of the Criminal Enforcement Code provides that supervision is imposed by a judge’s resolution in the manner prescribed by Article 5 of the Law “On Administrative Supervision Over Persons Released From Prison”. The following restrictions may be fully or partially imposed on persons subject to supervision:
- a) prohibition of leaving home (apartment) during specified hours,
- b) prohibition of visiting specified locations within a district (city);
- c) prohibition of going outside a district (city) on private business or limitation of the timing of such travel;
- d) registration with police authorities one to four times per month.
“In such cases, law enforcement authorities usually seek to impose the maximum possible frequency of registrations,” Drozdova & Partners Law Firm’s Senior Partner Mykhailo Honcharov commented on the case, “but due to our efforts, the man will have to register with police authorities only once a month instead of paying weekly visits to the police department.”
