Lawyers have told how to obtain compensation in the case of traffic an accident involving an EU-registered vehicle
Traffic accidents with foreign-registered (EU-registered) vehicles have become everyday routine on the Ukrainian roads. However, the matter of obtaining compensation for damage suffered in the case of a traffic accident is still open. What actions should a victim take to get compensation from a perpetrator who owns an EU-registered vehicle?
Generally, damage caused by a source of increased danger is compensated by a person who owns a vehicle under a relevant legal ground (through the right of ownership, another interest, a contractor agreement, a lease agreement, etc). However, the case of the EU-registered vehicles is much more complicated given that they are registered in a foreign state.
The problem can be handled in two ways depending on whether the owner of the relevant EU-registered vehicle has purchased an insurance policy from a foreign insurance company. In addition, the perpetrator may go anonymous by simply leaving the accident scene. What one should do if that is the case? Drozdova & Partners Law Firm Director Ms Olena Drozdova and advocate Ms Liliia Tkachuk were looking into the questions about who should claims be brought against and how to find the perpetrator in their article for AUTONEWS web-portal.
